At a minimum, one needs to remember that
there are VERY IMPORTANT differences in
the laws and court rules, not only from
state to state, but from county to
county within a given state and also
changes in the rules from one year to
the next. Many judges incorporate their
own rules too.
That means that it is imperative for you
to have your own current copy of the
applicable court (and specific judge)
rules for the court your case is being
decided before communicating with your
adversary or before filing any papers
with the court, with the exception of
your Answer, which you may prefer to get
that out of the way as soon as you can
so you are not faced with a default
judgment.
Responding to Papers on Time:
We can't complete papers for you because
of the states so called unauthorized
practice of law restrictions, but we
can tell you this:
As unpleasant as some of these matters
may be, the problem will not go away and
may get worse if you do not properly
address it within the applicable time
limits. One reason for this is that the
laws and court rules have time limits
built that can severely punish those who
fail to respect the system by not
complying with time requirements and
deadlines.
That means you must answer a complaint
in time, as for one of many examples –
and that is the time to make any
counterclaims or cross-claims –
generally, not later. It also means you
must proceed to properly implement
discovery demands and follow-up when
your adversary has not complied with
your properly prepared and served
demands, not only by a timely letter
but, if necessary, by the appropriate
motion to Compel Answers or for more
specific court relief.
The same important time-frames relate to
depositions, subpoenas, requests for
Judicial Notice (RJI, etc.) and
Notices/Demands to Produce, etc.
Basic Principles of Motion Practice:
The compliance with court rules by a
pro se party is especially important
because some (if not many) judges are
hostile toward pro se parties and
regularly engage in the despicable
double standard of allowing failures by
an attorney, while quipping that the
pro se party "should have hired a
lawyer".
